You must be at least 18 years old to use AppWizard. If you are under 18, you may only use the Platform with the active involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using AppWizard, you represent and warrant that you meet this age requirement or have obtained the required parental consent.

AppWizard provides a platform and service through which you can request custom-built applications. We provide:

• A user interface to submit your app idea and select a pricing tier
• Payment processing via Stripe
• App development and delivery
• Hosting for your delivered app (subject to your care plan)
• Customer communication and status updates

We are a tool and service provider only. We do not control, review, endorse, or take responsibility for the content, functionality, or use of any application we build for you beyond what was described in your original request.

You are solely and entirely responsible for:

• The description and instructions you provide to us
• The content, data, and information processed by or stored in your app
• How you use, share, or deploy your app
• Ensuring your app complies with all applicable laws and regulations in your jurisdiction
• Obtaining any required consents, licences, or permissions from third parties
• Your users' experience of and interaction with your app
• Any harm, loss, damage, or legal liability arising from or related to your app

We do not review apps for legal compliance, safety, or suitability before or after delivery. That responsibility rests with you.

All prices are listed in Canadian dollars (CAD) and do not include applicable taxes unless stated otherwise. Payment is processed securely by Stripe.

Because we begin work on your app immediately after payment is confirmed, all sales are final and non-refundable once your order is confirmed and work has commenced. If you believe there has been a billing error or technical issue, please contact us at support@appwizard.shop within 7 days of your purchase.

Monthly care plan fees, if applicable, may be cancelled at any time. Cancellation takes effect at the end of the current billing period.

Your app: The specific application we build for you, based on your unique description, belongs to you once payment is complete and delivery is confirmed. You are free to use it, modify it (with appropriate technical expertise), and share it.

Our platform: AppWizard, its name, branding, user interface, underlying codebase, AI prompting systems, templates, and methodologies are and remain the exclusive intellectual property of AppWizard Shop. You may not copy, reverse-engineer, resell, or reproduce any part of the Platform itself.

Similar apps: Because we build many apps with similar functionality (for example habit trackers and invoice tools), we retain the right to build similar apps for other customers using the same underlying components and approaches. Your specific data and unique configuration remain yours; the general patterns and templates remain ours.

Your content: Any content you submit to us (app descriptions, logo files, data, and similar material) remains yours. You grant us a limited licence to use it solely for the purpose of building and delivering your app.

You must not use AppWizard to request, build, or deploy any application that:

• Violates any applicable law or regulation
• Infringes on the intellectual property rights of any person or entity
• Contains, distributes, or facilitates illegal, harmful, threatening, harassing, defamatory, obscene, or fraudulent content
• Collects personal data without proper disclosure and consent
• Is designed to deceive, defraud, or mislead users
• Sends unsolicited communications (spam)
• Facilitates gambling, illegal weapons, controlled substances, or other regulated activities without proper licensing
• Contains adult-only content accessible to minors
• Impersonates any person, company, or service

Violation of this section may result in immediate termination of your account and legal action where appropriate. Please review our Acceptable Use Policy for full details.

The Platform and your delivered app are provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Security or freedom from viruses or harmful components
• Accuracy, completeness, or reliability of any output

To the maximum extent permitted by applicable law in Ontario, Canada, AppWizard Shop, its officers, directors, employees, contractors, and agents shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from misuse of your app or any user of your app
• Damages arising from third-party claims against you related to your app
• Damages resulting from data loss, security breaches, or service interruption

In no event shall our total liability to you exceed the amount you paid to us in the 12 months preceding the claim.

You are solely responsible for the apps you build. We are a platform and service provider, not a co-creator or co-owner of your app's outcomes.

You agree to indemnify, defend, and hold harmless AppWizard Shop and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Platform or your delivered app
• Your violation of these Terms
• Your violation of any law or the rights of a third party
• Any content or data you submit to us or that is processed by your app

We reserve the right to suspend or terminate your access to AppWizard at any time, with or without notice, if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or any applicable law.

You may stop using AppWizard at any time. Sections 4, 6, 8, 9, 10, and 13 survive termination of these Terms.

We collect and use your personal information (name, email, app descriptions, payment details) solely to provide the Platform and its services. We do not sell your data to third parties. Payment is handled by Stripe; we do not store your card details. Please review Stripe's privacy policy at stripe.com for more information on how they handle your payment data.

By using AppWizard, you consent to the collection and use of your information as described above.

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of AppWizard shall first be addressed through good-faith negotiation. If we can't resolve it informally, disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. If changes are material, we'll let you know via email. Your continued use of AppWizard after changes are posted constitutes acceptance of the new Terms.
